Two Swadlincote youths due in court as further murder charge is made following Benjamin Orton death

Two 17-year-old boys have been charged in connection with the death of Benjamin Orton, Derbyshire Police have reported.

One 17-year-old has been charged with murder and attempted murder while the other has been charged with assisting an offender and perverting the course of justice.

The pair, who are both from Swadlincote, are due to appear before magistrates in Derby today (Wednesday 16 June).

A 16-year-old boy who was earlier charged with murder, attempted murder and possession of an offensive weapon appeared at the same court yesterday afternoon and was remanded into custody to appear at Derby Crown Court on Thursday 17 June.

The three boys cannot be named for legal reasons.

Officers were called to reports of an assault in an alleyway at the side of the Odeon cinema, in Coppice Side, Swadlincote, just before 10.40pm on Saturday 12 June.

Benjamin (17), who was from Swadlincote, died at the scene. He had suffered stab wounds.

A 20-year-old man was also found with serious, and potentially life changing injuries. He was taken to hospital where he remains in a stable condition.

Derbyshire Police are still seeking further information and a spokesperson said: "We would urge anyone with information who hasn't yet come forward to contact us.
